A legal challenge against American sanctions

Washington also accuses him of encouraging Congolese military personnel to desert and of having resided in Goma, located in the eastern Democratic Republic of Congo, under the protection of the M23. His defense counsel maintains that the evidence presented by the American administration is “vague” and “arbitrary,” failing to concretely substantiate the actions attributed to him.

The defense demands concrete proof

Notably, the legal representatives for the former president emphasize that the American dossier lacks identification of any specific financial transfers to the AFC. They further assert that no Congolese military personnel are explicitly named as having been incited to desert by Joseph Kabila. The defense additionally points out that in 2013, during his presidential tenure, the Congolese army actively contributed to the M23’s defeat.

Joseph Kabila, who governed the Democratic Republic of Congo from 2001 to 2019, is now petitioning the federal court in Washington to lift the sanctions and remove his name from the OFAC list.
