Senegal’s political landscape shaken by legal battle over Ousmane Sonko’s seat

The Front for the Defence of the Republic (FDR) has escalated tensions in the National Assembly by formally demanding the removal of Ousmane Sonko from his parliamentary seat. The coalition, led by Khalifa Sall, has declared Sonko’s presence in the Assembly as both illegal and illegitimate in a publicly released statement.

The FDR’s declaration comes after a coalition of 147 political parties and movements signed a joint statement on May 24th, condemning what they describe as a parliamentary coup attempt by PASTEF. The opposition has also taken legal action by referring the matter to the Constitutional Council for review.

Legal arguments fuel the controversy

The FDR bases its claim on Article LO172 of the Electoral Code, which stipulates that a minister elected as a deputy must resign from their government position within eight days or forfeit their parliamentary mandate. The coalition argues that PASTEF attempted to circumvent this rule by amending the Assembly’s internal regulations, a move they deem unconstitutional on two critical grounds:

  • According to Article 54 of the Constitution, any changes to such provisions must be explicitly outlined in the Electoral Code through an organic law, rather than hidden within internal regulations.
  • The amendment introduces the concept of deputy substitutes, a category not recognized in Senegalese law outside of proportional and majority departmental elections.

In the FDR’s view, PASTEF’s actions represent a triple violation of the Constitution, the Electoral Code, and the Assembly’s own regulations. The coalition emphasizes that the Assembly’s regulations are strictly designed to govern internal procedures, as outlined in Article 1 of its framework.

The FDR is rallying national stakeholders to unite behind a strategic action plan aimed at upholding the rule of law in Senegal. The coalition urges all civic forces to mobilize in defense of the Republic’s legal and constitutional framework.
